We retain your account data for as long as your account is active. If you delete your account, we will remove your personal data within 30 days, except where retention is required by law or for fraud prevention purposes.

While we take security seriously, no system is completely immune to breaches. In the event of a data breach affecting your personal information, we will notify affected users promptly and take immediate remediation steps.

🖥️ 7. Desktop Application & Software

Our desktop software for Windows and macOS may collect the following limited information to function correctly:

• Software version number – to check for and deliver updates.
• Anonymous crash reports – if the application encounters an error, a report may be sent to help us diagnose and fix the problem. These reports contain technical details about the error but not your personal files or content.
• Operating system version & system architecture – for compatibility purposes.
• License activation data – when you sign in to activate a license, the application sends a device label (shown in the sign-in dialog, pre-filled with your computer's name and editable before you activate) and an anonymized device identifier (a one-way hash derived from your computer's configuration — never a hardware serial number) so we can enforce the device limits of your license plan. The device label is shown in your account's device list and is deleted from the active record when you deactivate that device; deactivation history keeps only an anonymous count.

Our software does not:

• Access, scan, or transmit your personal files.
• Record your keystrokes or screen activity.
• Run in the background without your knowledge.
• Install additional software without your consent.

👶 8. Children's Privacy

JL Tools LLC is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal data from a child under 13 without verified parental consent, we will delete that information promptly.

🚨 14. Data Breach Notification

In the event of a security breach that compromises your personal data, JL Tools LLC will:

• Contain and assess the breach within 72 hours of discovery.
• Notify affected users by email within 72 hours where the breach is likely to result in a risk to your rights and freedoms (as required under GDPR Article 33).

🗑️ 15. Account Termination & Data Deletion

You may delete your account at any time by contacting us at support@jltools.xyz. Upon account deletion:

• Your personal profile data (name, email, preferences) will be permanently deleted within 30 days.
• Software license keys associated with your account will be deactivated.
• Anonymized usage data that cannot identify you may be retained for analytics purposes.
• We may retain certain records for up to 7 years where required by law (e.g. financial records, fraud prevention logs).

JL Tools LLC reserves the right to suspend or terminate accounts that violate our Terms of Service, engage in fraudulent activity, or pose a security risk. In such cases, data retention follows the same schedule above.

⚠️ 16. Limitation of Liability

To the maximum extent permitted by applicable law, JL Tools LLC and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services or any unauthorized access to your data, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from your use of JL Tools LLC services shall not exceed the greater of (a) the amount you paid to JL Tools LLC in the twelve months preceding the claim, or (b) one hundred US dollars ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

⚖️ 17. Governing Law & Dispute Resolution

This Privacy Policy and any disputes arising from it shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to this Privacy Policy that cannot be resolved informally shall be submitted to binding arbitration in Miami-Dade County, Florida, under the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in English. Each party shall bear its own costs unless the arbitrator determines otherwise.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending arbitration.
